Service Definition

The services provided under this Agreement or related online and/or mobile services, websites, and software are detailed on the genape website www.genape.ai.

“Service” refers to the software services and platform provided by genape, including

(i) the network and other user interfaces, applications, and software provided to users, and (ii) any modifications, updates, derivative works, optional modules, customizations, or standard enhancements, updates, and upgrades to any of the foregoing.

The “website www.genape.ai,” “genape Content Reproduction Service,” and “services of genape” will generate new replicated content (Generated Content) for you based on your user content (defined below). For ease of reading, the terms “website,” “our services,” and “Generated Content” are collectively referred to as “Service” hereinafter.

 

Subscription and Refunds

Subscription Policy

By choosing to pay for the Service, you agree to the pricing and payment terms provided on genape.ai/pricing. genape reserves the right to, at any time, decide to add new services for additional fees and charges, and to increase or modify the fees and charges for existing services. Any changes to our pricing and payment terms will take effect within the billing cycle following the issuance of a change notice to you pursuant to this Agreement.

 

Subscription Plans

Depending on the number of team members, upper limits, costs, or other differences, the following plans are available for subscribing to the genape Professional Edition: Monthly Subscription (Auto-renewal) or Annual Subscription (Auto-renewal). genape subscriptions will automatically renew one month or one year after the purchase date. If a user cancels the subscription or genape is unable to deduct the next period’s fees, the content and tools included in genape will become unavailable starting from the first day after the end of the payment period.

 

Automatic Subscription

Upon subscribing to a plan, unless you notify us of your intent to cancel the subscription, it will automatically renew at the rate specified in your user account/checkout page. Any cancellation notice must be sent to us via email to [Customer Service Email] or through your billing page, and will take effect in the next billing cycle following the receipt of your notification.

Unless you notify us of your cancellation, your subscription and all associated fees will automatically renew, and you authorize us or our authorized third-party payment providers (unless otherwise required by applicable law, without further notice) to charge you the applicable subscription fees and any taxes using any eligible payment method we have on record for you.

 

Cancellation of Subscription

This service does not fall within the scope of the 7-day cooling-off period specified in Article 19, Paragraph 1 of the Consumer Protection Act. However, the company voluntarily provides a 5-day cooling-off period, as detailed below:

You may cancel your subscription and receive a full refund within 5 days from the date of initial purchase if no tokens have been used. After this period, you will not be able to cancel purchases and/or receive refunds of subscription fees at any time. However, we reserve the right to cancel your transaction for any reason, such as in cases of credit card fraud or notification from judicial authorities. If we cancel your transaction, we will refund any payments you have made for such transactions. Notwithstanding the foregoing provisions governing your initial subscription purchase, cancellations will take effect at the end of the current subscription period. Except as provided above regarding your initial subscription purchase, no refunds will be provided for subscription fees paid for the current subscription period upon cancellation. To cancel your subscription, you must manually do so on your billing page or send an email to [Customer Service Email]. If you cancel, your right to use the service will continue until the end of your current subscription period, at which point it will terminate without incurring any additional charges.

 

Free Trial

Genape may, at its discretion, offer free trial plans for a limited period, which may require registration to access.

Without prior notice, Genape reserves the right to (i) modify the terms of the free trial offer, or (ii) cancel such free trial offers.

If we provide you with a free trial, specific terms and conditions for the trial will be provided at the time of registration, and your usage of the free trial will be subject to these specific terms. Combining the free trial with any other promotions may be subject to certain restrictions. Unless otherwise specified in the specific terms of the free trial offer, the free trial is only available to users who have not previously subscribed to a paid plan.

 

Authorization for Third-Party Payments

  1. When you purchase a service subscription, you explicitly authorize us (or our third-party payment processors) to collect subscription fees from you. We may require you to provide additional information related to your subscription, including your credit card number, expiration date, email address, address, tax identification number, and invoice details for billing and notifications. You declare and warrant that you have the legal right to use any payment method represented by such payment information.
  2. When you activate a subscription, you authorize us to provide your payment information to third parties to complete transactions related to your subscription and charge your payment method (plus any applicable taxes and fees) based on the subscription type you selected. Before completing the subscription, you may need to provide additional information to verify your identity (such information is included in the definition of payment information). Activation of the subscription signifies your agreement to the pricing, payment, and billing policies applicable to such fees and charges, which have been published or otherwise conveyed to you. Unless explicitly stated in these terms, all subscription fees are non-refundable and non-transferable. All fees and applicable taxes (if any) are payable in New Taiwan Dollars.

 

Refunds

(1) If this subscription service is terminated by Genape due to business or technical reasons, or due to force majeure, any prepaid fees from the effective date of termination until the end of the subscription period will be refunded on a pro-rata basis.

(2) If the termination is initiated by the user or occurs due to significant breach of contract by the user resulting in termination by Genape, the subscription will not automatically renew upon the expiration of the payment term, nor will any refund be issued.

(3) Within 5 days from the date of initial purchase, if no tokens have been used, you may cancel your subscription and receive a full refund. Except for the aforementioned scenarios, you will not be able to cancel purchases and/or receive refunds of subscription fees at any time.

Note: Refunds are not automatic; you need to contact us directly via email at support@genape.ai within five days to request a refund.

 

Acknowledgment and Acceptance of Terms

 

In accordance with the Personal Data Protection Act, Element Interactive Technology Co., Ltd. (hereinafter referred to as “Genape”) collects, processes, and utilizes your personal data as required for business purposes. In compliance with regulations, we hereby inform you of the following, please read carefully:

 

1.1 Purpose of Collection: Genape provides services based on these Terms of Service (“the Service”). The purpose is for marketing and other business needs as defined by the Service.

 

1.2 Categories of Personal Data Collected: Various categories of personal data are collected, including but not limited to identification (e.g., name, phone number, mobile phone number, mailing and residential address, email address) and characteristics (e.g., date of birth), all in line with the purpose of collection.

 

1.3 Period, Region, Recipients, and Methods of Personal Data Utilization:

 

1.3.1 Period: The retention period for personal data collected for specific purposes complies with relevant legal provisions, contractual agreements, or the necessary retention period for providing the Service.

 

1.3.2 Region: The processing and utilization of personal data may occur domestically and internationally.

 

1.3.3 Recipients: Element Interactive Technology Co., Ltd., PlayConstruct Network Technology Co., Ltd., other related enterprises with relationships with Genape, both official and unofficial, and any third-party service or product providers necessary for providing the Service.

 

1.3.4 Methods: Utilized through automated machines or other non-automated means.

 

1.4 Rights Regarding Personal Data:

 

1.4.1 Inquiry or Access Request.

 

1.4.2 Request for Copy Production.

 

1.4.3 Request for Supplement or Correction.

 

1.4.4 Request for Cessation of Collection, Processing, or Utilization.

 

1.4.5 Request for Deletion.

 

However, Genape may not comply with your request under relevant laws.

 

1.5 Provision of Personal Data:

 

1.5.1 If you refuse to provide personal data, Genape may not be able to provide relevant services and may not be able to protect your interests.

 

1.5.2 Please provide correct, up-to-date, and complete personal data according to the requirements of each service. If your personal data changes, please actively apply for correction with Genape.

 

1.5.3 If you provide incorrect, outdated, incomplete, or misleading information that damages your relevant rights, Genape will not be liable for compensation.

 

  1. Genape provides services based on these Terms of Service (“the Service”). When a member completes the registration process for Genape membership or begins to use the Service, it signifies that they have read, understood, and agreed to accept all the contents of these Terms of Service and fully accept the existing and future service items and contents of the Service. Genape reserves the right to modify or change the contents of these Terms of Service at any time, and the modified Terms of Service will be published on the website. Genape will not individually notify members of these modifications or changes. It is recommended that members pay attention to such modifications or changes at all times. By continuing to use the Service after any modifications or changes, members are deemed to have read, understood, and agreed to accept such modifications or changes. If a member does not agree with the revised or updated Terms of Service or any other provisions of these Terms of Service, they should immediately stop using the Service.

 

  1. If a member is under the age of 18, they should have their parent(s) or legal guardian(s) read, understand, and agree to all the contents of this Agreement and its subsequent modifications and changes before they can register as a member and use or continue to use the Service. When a member uses or continues to use Genape, it is presumed that their parent(s) or legal guardian(s) have read, understood, and agreed to accept all the contents of this Agreement and its subsequent modifications and changes. When a member enters into a legally binding contract with Genape and only complies with this Agreement and all applicable local, state, national, and international laws, rules, and regulations, they can use the Service. It is strictly prohibited for anyone under the age of 13 (under 16 in Europe) to use or access the Service, otherwise, it will violate this Agreement. Any user previously removed by Genape from the Service will not be able to use the Service.

 

  1. Both the member and Genape agree that all the contents of the Service, including expressions of intent, are communicated electronically.

 

Member Registration Obligations

 

In order to use this service, members agree to the following:

 

  1. Provide accurate and up-to-date information as prompted by the registration form for this service, and not register as a member under the name of a third party. Each member can only register and log in with one account and may not register and log in repeatedly.
  2. Members should maintain and update their personal information promptly to ensure its accuracy for the best service.
  3. If a member provides any incorrect or untrue information, fails to provide information as instructed, lacks necessary information, or engages in repeated registration of accounts, Genape reserves the right to suspend or terminate the member’s account without prior notice and refuse the member’s use of all or part of this service.

 

Privacy Policy

 

Genape protects and regulates member registration and other specific data provided during service provision in accordance with the “Privacy Policy” of Genape. You can obtain it at www.genape.ai/privacy to understand how we collect, use, and share your information. The privacy policy may change as described therein. By accessing, using the service, or providing information through the service, you acknowledge that you have read and accepted our privacy policy and agree that we take all actions regarding your information according to the latest version of our privacy policy at that time.

 

Account, Password, and Security

 

  1. After completing the registration process for this service, members will register and log in with their Google account or email address. For the former, they will continue to use their original Google account password, while for the latter, they will obtain a specific password and member account. Maintaining the confidentiality and security of passwords and accounts is the responsibility of the member. Any input of member account and password consistent with login data, regardless of whether inputted by the member personally, will be presumed to be used by the member themselves. The member shall be fully responsible for all actions taken using the password and account.

 

You can control your customer account data and your interaction with this service by changing settings on the settings page.

 

If you represent a company, organization, or other entity when opening a customer account, “you” includes both you and that entity. By using third-party services to connect to Genape, you allow us to access and use your information from that third-party service as permitted by that third-party service and store your login credentials for that service.

 

  1. Members agree to the following:

 

2.1 Members should immediately notify Genape if their password or account is stolen or if any other security issues arise.

2.2 End the use of the member’s account after each session.

2.3 Member accounts, passwords, and member rights are for the personal use and enjoyment of the member only and may not be lent, transferred to others, or used jointly with others.

2.4 In the event of password or account theft, improper use, or other situations where Genape cannot determine whether it is used by the member personally, Genape shall not be liable for any resulting damages unless it can be proven to be attributable to Genape.

2.5 If Genape becomes aware that a member’s account and password have been used by others without authorization, the use of the account (including transactions made with the account) will be immediately suspended.

2.6 Genape will not request members to set or change payment methods at ATMs over the phone.

 

  1. If it is discovered through feedback that member’s personal information collected, processed, and utilized as mentioned above has been stolen, leaked, tampered with, or otherwise infringed upon, Genape will announce it on the Genape website for an appropriate period and take appropriate measures, including but not limited to suspending the provision of this service, after confirming.

 

  1. Member Responsibilities:

 

4.1 Without permission, you may not use other users’ user accounts.

4.2 You are fully responsible for activities on your customer account and must ensure the security of your customer account password.

4.3 You must immediately notify Genape of any security breaches or unauthorized use of your customer account. Genape is not responsible for any losses incurred due to unauthorized use of your customer account.

 

Fair Use Policy

 

  1. Genape is committed to providing high-quality and reliable services to all users. Genape encourages users to avoid abusing or excessively using Genape’s services because excessive usage by one user may affect the service quality for other users. Genape encourages users to choose plans that meet their professional needs and business scale. High-volume users are advised to upgrade to more powerful plans, apply for customized plans, or utilize our business API.

 

  1. Users are requested to operate within the specified parameter range. Exceeding these parameters may result in service access restrictions or reductions without prior notice. Genape’s system will monitor automated or robotic behavior to maintain service security and quality. Please note that sharing login information for unlimited accounts is illegal. Each account is intended for single-user use only, and multiple users sharing one account are not allowed. Abnormally high usage rates or sharing login information may result in account suspension or deletion without further notice, and refunds will not be provided.

 

Newsletter and EDM Sending

 

  1. By providing your email address to Genape, you agree to receive service-related notifications, including any legally required notifications, via email instead of postal mail.

 

  1. Members agree that Genape may periodically send newsletters or product messages (EDM) to the email account registered by the member. We may also use your email address to send you other messages, such as notifications of service feature changes and special offers.

 

  1. If you do not wish to receive such emails, you can choose to opt out or change your preferences in your settings page. Opting out may prevent you from receiving emails about updates, improvements, or offers.

 

Changes to Terms or Services

 

  1. We may update the terms from time to time, and if we do, we will post the updated terms on the website. When we update the terms or when you use the service, please be sure to review the terms. If you continue to use the service after we publish the updated terms, it means you accept and agree to those changes. If you do not agree to the changes, you may not be able to use the service anymore.

 

  1. Members agree that within the scope of the services provided by Genape, Genape may increase, decrease, modify, or terminate relevant service items or content based on business needs and actual circumstances, without individual notice to members, and we will not assume any liability. We may also limit user access (including registered users) to certain parts or the entire service from time to time.

 

  1. We may change the service without notice; we may also stop providing services or certain features to paid users or unpaid general users or create usage restrictions for services. We may permanently or temporarily terminate or suspend your use of the service for any reason, without notice and without any liability, including but not limited to if we determine, in our sole discretion, that you have violated any provision of this Agreement. You will continue to be bound by this Agreement after termination for any reason.

 

  1. Members agree that Genape may increase, modify, or terminate relevant activities according to actual execution situations and choose the most appropriate way to inform members.

 

  1. Genape will regularly update the technical, content, and other information on the website. In addition, Genape reserves the right to change the website without further notice.

 

Service Interruption or Suspension

 

  1. Genape will maintain the normal operation of the system and service using generally reasonable technical means. However, Genape has the right to suspend some or all services without prior notice in the following circumstances:

– When necessary maintenance and construction are carried out on the electronic communication equipment of the Genape website.

– In the event of a sudden failure of electronic communication equipment.

– When the electronic communication service applied for by the Genape website is suspended and unable to provide services.

– When the Genape website is unable to provide services due to force majeure or other factors beyond Genape’s control.

– When the system traffic is overloaded.

– When the system is closed for operational or technical reasons as determined by the company.

– If we find that your use is causing harm to the company and/or other users or violating the terms in the prohibited activities, we may suspend or terminate your usage rights at any time until the issue is resolved.

 

  1. The company shall not be liable for any damages caused to users or third parties due to service suspension or interruption.

 

Termination of Service

 

Grounds for Termination:

(1) Termination initiated by the client.

(2) If the client commits a significant breach as mentioned above, Genape reserves the right to terminate the subscription service proactively.

(3) Genape may proactively terminate the subscription service for business or technical reasons.

(4) Genape may proactively terminate the subscription service due to force majeure, including natural disasters such as typhoons, earthquakes, floods; government actions such as requisitions, expropriations; social abnormal events such as strikes, riots, etc.

(5) For business or technical reasons, we may terminate the service. In such a case, users will be notified 30 days prior to termination.

 

Disclaimer

The service is provided on an “as-is” and “as-available” basis. Use of the service is at your own risk. To the maximum extent permitted by law, the service is provided without any form of express or implied warranty, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Any advice or information obtained from Genape or through the service, whether oral or written, will not create any warranty not expressly stated in this Agreement. Unless expressly stated otherwise, Genape, its subsidiaries, affiliates, and licensors do not warrant the accuracy, reliability, or correctness of the content; do not warrant that the service will meet your requirements, will be available at any particular time or location, uninterrupted or secure; do not warrant that any defects or errors will be corrected; or do not warrant that the service is free of viruses or other harmful components. Any content obtained through the use of the service is used at your own risk, and you will be solely responsible for any damage resulting from it, unless expressly provided otherwise herein, including damage to computer systems or mobile devices or data loss resulting from such downloads or use of the service.

The disclaimers and exclusions in this Agreement do not apply to the extent prohibited by law.

Additionally, Genape does not warrant, endorse, or assume any responsibility for any products or services advertised or offered by third parties through the service or any hyperlinked website or service, and Genape will not be a party to or in any way monitor any transaction between you and third-party product or service providers.

 

Limitation and Exclusion of Liability

 

  1. All functions provided by this service are offered based on their current status, and Genape assumes no express or implied warranty liability for their performance, speed, completeness, reliability, security, accuracy, etc.

 

  1. Genape does not guarantee that emails or their contents transmitted by the web pages, servers, domains, or any other part of this service are free from harmful elements such as computer viruses. Genape also does not guarantee the correctness, accuracy, uninterrupted transmission, or error-free storage of emails, files, or data. Genape shall not be liable for any damages arising from the failure, loss, or error in the transmission or storage of such emails, files, or data.

 

  1. Genape shall not be liable in any circumstances for: (a) indirect, incidental, consequential, special, punitive damages; (b) increased costs, decreased value, or loss of business, production, income, or profits; (c) loss of reputation or goodwill; (d) use, inability to use, data loss, interruption, delay, or recovery, or the infringement of data or system security; or (e) the cost of replacing goods or services, regardless of whether Genape has been informed of the possibility of such losses or damages, or whether such losses or damages are foreseeable. Genape shall not be responsible for any damages, losses, or injuries to your account or the information contained therein caused by hacker attacks, tampering, or other unauthorized access or use.

 

  1. To the maximum extent permitted by law, Genape shall not be liable for: (I) errors, mistakes, or inaccuracies in the content; (II) any nature of personal injury or property damage resulting from your access to or use of the service; (III) any unauthorized access to or use of our secure servers and/or any personal information stored therein; (IV) any interruption or cessation of transmission to or from the service; (V) any errors, viruses, trojans, or similar items transmitted by third parties through the service; (VI) any errors or omissions in any content or any loss or damage incurred as a result of using any content posted, sent, transmitted, or otherwise made available through the service; (VII) user content or any defamation, offense, or illegal conduct of any third party.

 

  1. This limitation of liability applies to contractual, tortious, or any other claims basis, even if Genape has been advised of the possibility of such damages.

 

  1. The disclaimers, exclusions, and limitations of liability in this agreement shall apply to the extent permitted by law.

 

Third-Party Website Links

 

  1. Links to third-party websites may be available on this website. Such links are provided solely for the convenience of users. Their existence does not imply endorsement or recommendation by Genape. Third-party products are subject to their own terms and conditions, which are provided to you through website links or other means for acceptance within the service. If you do not agree to comply with the applicable terms of any such third-party product, you should not install, access, or use it. Additionally, Genape does not guarantee their security or meet user expectations. Genape shall not be liable for any direct or indirect damages or losses resulting from the use of services provided by third-party websites.

 

  1. Furthermore, any transactions or participation in promotional activities with advertisers on the service, including payment and delivery of goods, and any other terms (such as warranties), are solely between you and such advertisers. You agree that Genape shall not be responsible for any type of loss or damage related to your transactions with such advertisers. Any other terms (such as warranties) are solely between you and such advertisers.

 

Intellectual Property Rights

 

  1. By uploading, posting, sending, receiving, storing, or otherwise providing content, including but not limited to text, images, audiovisuals, and reviews (hereinafter referred to as “Content”), through Genape or this service, you represent and warrant that you have all necessary rights and/or authorizations and can use Genape-related services in accordance with these terms.

 

  1. You understand and agree that you are solely responsible for all claims and losses arising from the content you provide and any use of the content on Genape. You warrant that the content provided does not infringe, misappropriate, or violate the intellectual property rights, including but not limited to patents, copyrights, trademarks, trade secrets, personality rights, other proprietary rights, intellectual property rights, portrait rights, or privacy rights of others, nor does it violate any other relevant laws.

 

  1. You understand and agree that, to assist members in other languages to understand this service, we may need to provide partial or complete translation services. Genape does not guarantee the accuracy and quality of the translation results, and members are responsible for reviewing and confirming the accuracy of the translation results themselves.

 

  1. Protection of Children and Adolescents: In order to prevent children and adolescents from being harmed by browsing or using Genape and to ensure the safe use of the internet by children and adolescents, you understand and agree that you cannot upload, post, send, receive, store, or otherwise provide any content, including but not limited to text, images, audiovisuals, and reviews, that may endanger the physical and mental health of children and adolescents, such as violence, gore, or pornography on Genape. If any violation of this provision is found, Genape reserves the right to delete it.

 

User’s Legal Obligations and Commitments

 

You understand and agree never to use the Genape service for any illegal purpose or in any unlawful manner, and you commit to complying with relevant laws of the Republic of China and all international practices for internet use. If you are a user outside the Republic of China, you agree to comply with the laws of your country or region. You agree and warrant not to use this service to engage in activities that infringe upon the rights of others or violate the law, including but not limited to:

 

  1. Uploading, posting, publishing, or transmitting any text, images, audiovisuals, or any form of files on this service that involve defamation, insults, violence, threats, attacks, indecency, pornography, obscenity, falsehood, violation of public order or good customs, or other unlawful content.
  2. Infringing upon the reputation, privacy rights, trade secrets, trademark rights, copyrights, patent rights, other intellectual property rights, and other rights of others.
  3. Violating confidentiality obligations under law or contract; impersonating others when using this service.
  4. Uploading, posting, transmitting, or distributing any data containing computer viruses or any code that disrupts, damages, or limits the functionality of computer software or hardware.
  5. Engaging in illegal transactions or posting false or misleading messages that incite criminal activity.
  6. Sending spam emails, junk mails, chain letters, or similar messages.
  7. Engaging in illegal multilevel marketing messages on Genape.
  8. Falsifying message sources or interfering with the identification of transmission sources in any way.
  9. Interfering with or disrupting the service or servers, networks connected to the service, or failing to comply with related requirements, procedures, policies, or rules for connecting to the service, including but not limited to using any device, software, or intentionally bypassing our exclusion of automated search headers (robot exclusion headers).
  10. Tracking others or interfering with others or collecting or storing personal information of others for any of the aforementioned purposes; any other illegal or inappropriate behavior. You understand that the above actions may result in civil liability or criminal prosecution against you. As search engines and related platforms have corporate social responsibility, we reserve the right to retain relevant information and provide it to judicial authorities if we find that you have engaged in the aforementioned actions.

 

Protection of Personal Data

 

From the moment you start using Genape, we will follow the Personal Data Protection Act and relevant laws and regulations to protect your personal data to the best of our ability. All personal or other data collected by us is used solely for the purpose of providing services and will not be disclosed to any third party without authorization.

 

You understand and agree that for the purpose of assisting you in handling financial flows, completing payment transactions, and preventing your account information and Genape from being used as tools for fraud, money laundering prevention, and other criminal activities, when you use Genape’s financial flow-related functions, you must provide correct name and credit card information for our verification, and if there are any errors in the relevant information leading to your inability to use the payment and receipt functions or errors in payment transfer, you shall be responsible for them.

 

Authorization of Members to Genape

 

Regarding the data uploaded, transmitted, inputted, or provided by members, whether paid members or unpaid general members, it is agreed that Genape website may collect, process, save, transmit, and use such data within a reasonable scope to provide users with better information or service experience, or to create member statistics, or to conduct investigations or research on internet behavior, or for any legitimate use. If a member has no legal right to authorize others to use, reproduce, publicly dictate, publicly broadcast, publicly perform, publicly transmit, adapt, distribute, publicly display, or publish intellectual property rights and patent rights, please do not upload, transmit, input, or provide such data to Genape. If Genape is mistakenly regarded as infringing the intellectual property rights of a third party due to this, the member shall be liable for damages to Genape (including but not limited to litigation costs and attorney fees).

 

Authorization and Public Disclosure of Generated Content

 

  1. During the paid subscription period, you retain full ownership and other intellectual property rights to the content generated by Genape, including but not limited to images, audiovisuals, and information (hereinafter referred to as “Content”).

 

  1. For the content authorized by you, Genape has the permanent right to use, reproduce, publicly dictate, publicly broadcast, publicly perform, publicly transmit, adapt, distribute, publicly display, or publish intellectual property rights and patent rights globally, and has the permanent right to reauthorize other users. Genape reserves the right to provide assets to the public and to use them for commercial purposes to provide, maintain, promote, and improve services.

 

  1. Content generated by unpaid general members is presumed to be authorized for use by Genape. Genape has the permanent right to use, reproduce, publicly dictate, publicly broadcast, publicly perform, publicly transmit, adapt, distribute, publicly display, or publish intellectual property rights and patent rights globally, and has the permanent right to reauthorize other users. Genape reserves the right to provide assets to the public and to use them for commercial purposes to provide, maintain, promote, and improve services.

 

Refusal or Termination of Member Use

 

Members agree that Genape may, for the purpose of maintaining transaction security or any other reason, including but not limited to lack of use or violation of the express provisions and spirit of these terms of service, terminate the use of a member’s password, account (or any part thereof), or this service (or any part thereof), or remove and delete any “member content” within this service. Additionally, members agree that if the use of this service (or any part thereof) is terminated, Genape shall not be liable to the member or any third party.

 

Governing Law and Jurisdiction

 

The interpretation and application of these terms of service, as well as disputes or disputes arising from transactional behavior between members and Genape, shall be handled in accordance with the laws of the Republic of China, and the first instance jurisdiction shall be the Kaohsiung District Court, Taiwan.
